This Privacy Policy explains how AGGREGATIVE VALUE SOLUTIONS AGGVAL LLC, a New Mexico limited liability company, business record no. 0008069238 (AGGVAL, POSDriven, we, us or our), handles personal information through POSDriven websites, applications, dashboards, APIs and related services (the Service).

1. Our role

For account, billing, website and support information, AGGVAL generally acts as the business or controller responsible for the processing.

When a customer uses POSDriven to process information about its own customers, employees, suppliers or other persons, that customer generally determines the purposes and means of processing. In that context, AGGVAL acts as a service provider or processor on the customer’s instructions. Requests concerning data entered by a POSDriven customer should normally be directed to that customer first.

2. Information we collect

Depending on use of the Service, we may collect:

  • Account and contact data: name, business name, email, telephone number, role and login identifiers.
  • Business and configuration data: stores, locations, products, prices, taxes, users, permissions and integration settings.
  • Transaction and operational data: sales, orders, inventory movements, receipts, customer or supplier records and related metadata entered by customers.
  • Billing data: subscription, invoice and payment-status information. Payment card or bank credentials are normally collected directly by payment providers rather than stored by us.
  • Device and technical data: IP address, browser, operating system, device identifiers, application version, logs, diagnostics, crash reports and security events.
  • Usage data: features used, pages viewed, actions performed and support interactions.
  • Cookie and local-storage data: session, authentication, security, preference and analytics data as described in the Cookie Policy.

We receive information directly from users, from customer organizations, automatically from devices and systems, and from service providers or integrations authorized by the customer.

3. How we use information

We use personal information to:

  • provide, authenticate, configure and operate the Service;
  • process subscriptions, billing and customer support;
  • secure accounts, prevent abuse and investigate incidents;
  • maintain, troubleshoot and improve reliability and functionality;
  • communicate service, security, billing and product information;

  • create aggregated or de-identified information that does not reasonably identify a person.

Where applicable law requires a legal basis, processing may rely on contract performance, legitimate interests, legal obligations or consent.

4. Customer responsibilities

Customers are responsible for providing required privacy notices, obtaining required permissions or consents, configuring access appropriately and using the Service consistently with applicable privacy, employment, consumer and sector-specific laws.

Customers must not submit sensitive personal information unless it is necessary, lawful and supported by appropriate safeguards and a written agreement with us where required.

5. How we disclose information

We may disclose information to:

  • cloud hosting, authentication, email, monitoring, support and security providers;
  • payment processors and billing providers;
  • integrations selected or enabled by the customer, including fiscal, accounting, marketplace or communications services;
  • professional advisers, insurers, auditors and authorities where reasonably necessary;
  • a successor in a merger, financing, acquisition, restructuring or sale of assets; and
  • other parties when directed or authorized by the customer or user.

Providers may use information only to perform contracted services or as independently disclosed by them. We do not sell personal information for money and do not use customer operational data for third-party advertising.

6. International processing

AGGVAL is a United States company and may use providers or infrastructure in different countries. Information may therefore be processed outside the country where it was collected. Where required, we use contractual or other lawful safeguards for international transfers.

7. Retention and deletion

We retain account, billing and operational information for as long as necessary to provide the Service, maintain security, meet legal or tax obligations, resolve disputes and enforce agreements.

Customer Data is retained during the account term and for a limited period after termination to support recovery, legal compliance and orderly deletion. Retention may vary by data type, configuration, backup cycle, contractual commitment and applicable law. Customers should export required records before account closure.

We may retain aggregated, de-identified, security and audit information where it no longer reasonably identifies an individual or where continued retention is legally permitted.

8. Security

We use reasonable administrative, technical and organizational measures designed to protect information, including access controls, authentication, logging, encryption where appropriate and provider safeguards. No system can guarantee absolute security. Users must protect credentials and devices and promptly report suspected incidents.

9. Privacy rights

Depending on location and applicable law, individuals may have rights to access, correct, delete, restrict or object to processing, receive a portable copy, withdraw consent or appeal a decision.

For Customer Data controlled by a POSDriven customer, we may direct the request to that customer or assist the customer as required.

10. Children

The Service is intended for businesses and is not directed to children. We do not knowingly collect personal information directly from children through account registration. Customers remain responsible for lawful processing of any information they enter into the Service.

11. Changes to this Policy

We may update this Policy to reflect legal, operational, security or product changes. The effective date will be revised, and material changes will be communicated through the Service, website or account email when reasonably practicable.
